Novice Driver Violations

Novice Driver Offences

At Traffic Paralegal Services, we understand the unique challenges and obligations associated with novice or new drivers in Ontario. The laws surrounding new drivers are complex and require professional handling if you are to safeguard your driving future. Here is a comprehensive guide to understanding the matter:

Who Is A Novice Driver?

It is typically someone who holds a G1, G2, M1, or M2 license in Ontario. These licenses indicate a stage of learning, and as such, there are specific restrictions and rules that apply to individuals holding these licenses.

  • G1, M1: These are beginner stages where drivers are allowed to practice under the supervision of a fully licensed driver.
  • G2, M2: These are intermediate stages that still impose specific limitations but offer more driving freedom compared to G1, M1.

What Restrictions Apply to Novice Drivers?

They face several restrictions under Ontario law. These include:

Zero Tolerance for Alcohol or Drugs

Ontario law strictly enforces a zero-tolerance policy for alcohol or drugs for novice drivers. This means that novice drivers must have absolutely no alcohol or prohibited substances in their system while operating a vehicle. The policy aims to prevent impaired driving and promote responsible habits among new drivers.

Limited Hours of Driving

Depending on the license type, novice drivers may be subjected to restrictions on when they can drive. For instance:

  • G1 drivers must not drive between midnight and 5 AM.
  • Some G2 drivers under 19 years old may face restrictions on the number of young passengers they can carry during nighttime hours.

These limitations are set to ensure the driver gains experience in lower-risk conditions before moving on to more complex driving situations.

Specific Passenger Restrictions

Passenger restrictions are imposed to minimize distractions and risks. Examples include:

  • G1 drivers must be accompanied by a fully licensed driver with at least four years of experience.
  • G2 drivers under the age of 19 may face limitations on the number of passengers aged 19 or under during nighttime hours.

These restrictions help novice drivers focus on the road and hone their skills without unnecessary distractions.

Rules Regarding Highway Usage

Highway driving can be more challenging and requires a higher level of skill. As such, specific rules apply to novice drivers:

  • G1 drivers may only drive on a highway if accompanied by a licensed driving instructor.
  • Some highways may be completely off-limits to G1 drivers, even with an instructor present.

These rules ensure that the novice driver gains appropriate experience before taking on the more demanding task of highway driving.

Violating these restrictions can result in new driver violations, leading to severe consequences.

When Escalating Penalties Apply?

Escalating penalties apply to novice drivers who repeatedly commit offences under the Highway Traffic Act or other new driver offences. The penalties escalate depending on the frequency and severity of the violations.

What Penalties Can Be Imposed if Sanctions Are Escalated?

If sanctions are escalated due to multiple novice driver violations, the penalties can be severe. They might include:

  • Fines and fees
  • Suspension or cancellation of the license
  • Extension of the novice licensing period
  • Compulsory attendance in an education or treatment program

Fighting a Novice Driver Ticket becomes essential when facing these penalties, as they can have lasting impacts on a driver’s record and future.

I was really very appreciative of the efforts of Traffic paralegal services (Caledon office) and the way they managed my traffic ticket. I spoke to Leanne after being issued with an unfair traffic ticket by a belligerent, somewhat biased police officer who was overbearing and seemed to take pleasure in exercising his inflated sense of power! I called the Caledon office in a distraught state and explained my particular situation. I felt truly "heard" by Leanne who was very understanding, helpful and took the time to listen to my story offering useful feedback in a comforting and kind manner. I was at risk of not only a $600 plus fine but also demerit points and a sure increase in insurance if I was charged not to mention my clean record being smeared!Traffic paralegal services were professional, updated me regularly and my charges and fine were withdrawn leaving my record intact! I was mostly grateful for Leanne who took into account my particular situation and the circumstances of the issuance of the traffic ticket and took it in hand to fight my case. Very satisfied with the outcome and the pleasant hassle free process thanks to Leanne and her team!

My experience was really disappointing. I paid double the cost of my ticket for their services, only to be left with the same offer the prosecution gave me on day 1. Nothing was reduced, not the charge or points so it was a waste of money for me. Everyone I interacted with at Traffic Paralegal Services was nice but I wasn't paying $700 for that... at the most, they delayed the case a few months but overall, I wouldn't recommend.
